1 About Us & These Terms

These Terms of Service ("Terms") govern your access to and use of the website biosuretestkit.com (the "Site") and the purchase of any products from Bio Sure Test Kit ("we", "us", or "our").

These Terms constitute a legally binding agreement between you ("you", "customer", or "purchaser") and Bio Sure Test Kit. They should be read together with our Privacy Policy, which explains how we handle your personal data in accordance with the Personal Data Protection Act 2010 (PDPA).

We are an online retailer of self-testing health kits serving customers across Malaysia. Our Site is operated from and governed by the laws of Malaysia.

2 Eligibility to Purchase

To place an order on our Site, you must:

• Be at least 18 years of age and have full legal capacity to enter into a contract under Malaysian law.

• Use a valid Malaysian or internationally accepted payment method.
• Not be prohibited by any applicable law from purchasing the products we sell.

By placing an order, you represent and warrant that you meet all of the above requirements. We reserve the right to refuse service, cancel orders, or terminate accounts if we reasonably believe these requirements are not met.

3 Your Account

You may browse our Site without creating an account. However, certain features (such as order tracking and saved addresses) may require registration.

Our test kits are designed for single-use, at-home self-testing. They are not intended for clinical, diagnostic, or professional laboratory use. Any result obtained from a self-test kit should be confirmed by a healthcare professional or accredited laboratory.

4.3 Certification & Compliance

Where applicable, our products carry the relevant certifications required under Malaysian law. If you require specific certification information for any product, please contact us before placing your order.

5 Pricing & Payment

5.1 Pricing

All prices displayed on the Site are in Malaysian Ringgit (RM) and are inclusive of any applicable taxes unless stated otherwise. We reserve the right to adjust prices at any time without prior notice. Price changes will not affect orders that have already been confirmed.

5.2 Payment Methods

We accept the following payment methods for customers in Malaysia:

• Online Banking (FPX) — via major Malaysian banks.
• DuitNow QR — scan and pay using any participating banking or e-wallet app.
• Credit & Debit Cards — Visa, Mastercard, and other major cards.
• E-Wallets — Touch 'n Go eWallet, GrabPay, and Boost.
• Cash on Delivery (COD) — available for selected areas within Peninsular Malaysia.

Payment must be made in full at the time of purchase (or upon delivery for COD orders). We do not store full payment card details on our servers.

5.3 Payment Security

All online payments are processed through PCI-DSS compliant payment gateways. We are not responsible for any unauthorised transactions caused by your failure to keep your payment credentials secure.

6 Order Acceptance

Placing an order on our Site constitutes an offer to purchase, not a confirmed contract. A contract between you and Bio Sure Test Kit is formed only when we send you an Order Confirmation email.

6.1 Order Process

1. You place an order — by completing the checkout process on our Site.
2. We acknowledge receipt — you will receive an automated email confirming that we have received your order.
3. We confirm acceptance — once your order has been reviewed and accepted, we will send you an Order Confirmation with tracking details (where applicable).
4. We dispatch your order — your items will be shipped in accordance with our delivery timelines.

6.2 Right to Decline

We reserve the right to decline or cancel any order for reasons including, but not limited to:

• Product unavailability or stock inaccuracy.
• Pricing errors or technical glitches on the Site.
• Suspected fraudulent or unauthorised transactions.
• Failure to meet eligibility requirements under these Terms.

If we cancel your order, you will receive a full refund to your original payment method within the timeframe specified in Section 8.

7 Delivery & Risk

7.1 Delivery Areas & Timelines

• Peninsular Malaysia: 1–3 business days.
• Sabah & Sarawak: 3–7 business days.
• International: Delivery timelines will be quoted on a case-by-case basis.

Delivery timelines are estimates only and are not guaranteed. Delays may occur due to courier issues, public holidays, weather conditions, or other factors beyond our reasonable control.

7.2 Delivery Charges

Shipping fees are calculated at checkout based on your delivery address and order weight. Any applicable delivery charges will be displayed before you confirm your purchase.

7.3 Risk & Ownership

Risk of loss or damage to the goods passes to you upon delivery to the address provided at checkout. If you provide an incorrect or incomplete address, we are not liable for non-delivery.

7.4 Failed Delivery

If delivery is unsuccessful due to your unavailability or refusal to accept the goods, the courier may return the parcel to us. In such cases, we may charge a redelivery fee or deduct the original shipping cost from any refund.

8 Cancellations & Refunds

8.1 Order Cancellation by You

You may request to cancel your order before it has been dispatched. Once an order has been shipped, it cannot be cancelled — you may instead follow our Returns process (Section 9).

To request a cancellation, contact us at support@biosuretestkit.com with your order number. We will confirm the cancellation and process a full refund within 7–10 business days.

8.2 Refunds

Where a refund is approved, it will be issued to your original payment method. Refund processing times may vary depending on your bank or payment provider (typically 7–10 business days).

Refunds will not be issued for:

• Products that have been opened, used, or damaged after delivery.
• Change of mind after the product has been dispatched (unless the product is defective).
• Delivery delays caused by factors outside our control.

9 Returns & Exchanges

9.1 Return Eligibility

You may request a return within 7 calendar days of receiving your order if:

• The product is defective, damaged, or materially different from its description.
• The wrong item was delivered.
• The product has not been opened, used, or tampered with (for non-defective returns).

9.2 How to Initiate a Return

To begin a return, email us at support@biosuretestkit.com with:

• Your order number.
• A description of the issue.
• Photographs of the product (if damaged or defective).

9.3 Return Shipping Costs

• Our error (defective/wrong item): We will bear the return shipping cost.
• Change of mind: You will bear the return shipping cost.

10 Acceptable Use of Our Website

You agree to use our Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use and enjoyment of, any other person.

10.1 You Must Not:

• Use the Site for any fraudulent, illegal, or unauthorised purpose.
• Attempt to gain unauthorised access to our systems, servers, or databases.
• Introduce viruses, malware, or any other harmful code.
• Scrape, data-mine, or systematically extract content from the Site.
• Impersonate any person or entity, or misrepresent your affiliation with anyone.
• Post or transmit any abusive, obscene, defamatory, or discriminatory content.
• Interfere with the proper operation of the Site or the servers used to make it available.

10.2 Consequences of Breach

We reserve the right to suspend or terminate your access to the Site, cancel any pending orders, and take appropriate legal action if you breach these Terms.

11 Our Intellectual Property

All content on this Site — including text, graphics, logos, icons, product images, page layouts, and software — is the property of Bio Sure Test Kit or its licensors and is protected by Malaysian and international copyright and trademark laws.

You may not reproduce, distribute, modify, display, or transmit any part of this Site without our prior written permission, except as necessary to browse and make legitimate purchases.

12 Limitation of Liability

To the maximum extent permitted by Malaysian law:

• Bio Sure Test Kit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products purchased from us.
• Our total liability to you for any claim arising from these Terms shall not exceed the total amount you paid for the product giving rise to the claim.
• We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, courier disruptions, or government actions.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the Consumer Protection Act 1999 or any other applicable Malaysian law.

13 Indemnity

You agree to indemnify and hold harmless Bio Sure Test Kit, its directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your breach of these Terms.
• Your misuse of any product purchased from us.
• Your violation of any law or the rights of any third party.

14 Governing Law & Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia, including the Consumer Protection Act 1999 and the Personal Data Protection Act 2010.

14.2 Dispute Resolution

If a dispute arises, we encourage you to first contact us directly at support@biosuretestkit.com so we can attempt to resolve the matter amicably.

If the dispute cannot be resolved informally, you may refer it to:

• Tribunal for Consumer Claims (TTPM) — under the Consumer Protection Act 1999, for claims within its jurisdiction.
• The courts of Malaysia, which shall have exclusive jurisdiction over any legal proceedings.

15 Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or the services we offer. When we make changes:
